Family-Based Immigrant Visas

If you are a foreign national and want to permanently live and work in the United States, you must apply for permanent residency. A family-based immigrant visa is one of your options and requires a family member who is a U.S. citizen or lawful permanent resident to sponsor you. If you hope to become a U.S. citizen, permanent residence is a mandatory step to apply for naturalization.

The United States Citizenship and Immigration Services (USCIS) allows U.S. citizens and green card holders to sponsor certain relatives depending on the sponsor’s legal status and the family relation to the intending immigrant. Lawful permanent residents can only sponsor a spouse, unmarried children under 21, and/or an unmarried adult son or daughter of any age.

Requirements to Apply for a Family-Based Immigrant Visa

  • Your sponsoring relative must properly fill out and file the I-130 Petition for Alien Relative.
  • The U.S. Citizenship and Immigration Services (USCIS) must approve this petition.
  • Your sponsoring relative must complete, sign, and submit an Affidavit of Support to prove he/she has sufficient resources to support you, the intending immigrant.

Family-Based Nonimmigrant Visas

U.S. citizens also have the option to petition for a family-based nonimmigrant visa for their fiancés, spouses, and other relatives. These visas include the K-1, also known as “fiancé visa,” and allow your sponsored relative to continue his/her immigration process in the U.S.
