EB-2 Visa Attorney in Washington, DC

Comprehensive Legal Guidance in Washington, DC, for EB-2 Petitions

The EB-2 employment-based second-preference visa category is built for professionals with advanced degrees and persons of exceptional ability in the sciences, arts, or business. At The Law Firm Of Shihab & Associates, we represent EB-2 applicants from our Washington, DC, office, handling advanced degree petitions, exceptional ability cases, and national interest waiver filings for clients across the District and the broader National Capital Region.

Founder Gus M. Shihab has personally secured EB-2 and national interest waiver approvals for scientists, professors, researchers, and others. That direct case experience means we arrive at your petition already fluent in the evidentiary standards the U.S. Citizenship and Immigration Services (USCIS) applies to your specific category, whether you’re submitting a detailed publication record, a citation analysis, or documentation of peer recognition in your field.

How EB-2 Eligibility Works

There are two routes into the EB-2 category.

These routes are as follows:

  • Advanced degree professional: This path requires the petitioner to have a U.S. master’s degree or higher (or a foreign equivalent) or a bachelor’s degree combined with five years of progressive post-degree experience.
  • Exceptional ability: The exceptional ability path requires evidence of ability substantially above the normal level in your field of arts, business, or sciences, typically demonstrated by satisfying at least three of six regulatory criteria set out by USCIS.

Under both standard paths, an employer must provide a job offer and obtain an approved labor certification from the U.S. Department of Labor before filing Form I-140. The national interest waiver removes that requirement entirely, allowing qualified professionals to self-petition. We evaluate each client’s credentials and career trajectory to determine which path fits best before any filing begins.
